Only applicable to clients who deliver to UGC DSPs over FUGA deals.
FUGA takes a combined approach towards the standards expected within UGC content submissions.
Exclusive ownership must be held on a sound recording used in an asset that is claimed for monetisation (‘asset rights claim’ in Fuga Next). Revenue will be earned when an asset appears in user generated content on the UGC services (Youtube, Facebook, Soundcloud, TikTok).
Not all content is eligible to be claimed for monetisation. Content for which sufficient rights are not held should not be claimed for monetisation purposes. You are responsible for avoiding claims that result from misidentified content or claims that interfere with authorized uses of content.
The following rules apply in deciding that content is ineligible to claim for monetisation purposes.
Exclusive rights
Any type of sound recordings for which exclusive copyrights are not held. This involves covers, unofficial remixes, karaoke or sound-alikes. Compilations, live recordings and various artist ‘best of’ releases are generally ineligible, as copyrights to all compositions are likely not held.
Public domain content
Sound recordings or video footage of compositions in the public domain. Copyrights on the compositions have expired, making the content ineligible for monetisation.
Generic content
Insufficiently distinct content, also called ‘generic content’, involves nature sounds, ambient sounds, ASMR, white noise, binaural audio, sound effects, loops, soundbeds, demos and meditative content (fe. music for sleeping, etc).
Royalty free content
Royalty free production music libraries typically licensed for use in game, film, TV or other soundtracks.
Recording of a non-musical work
Audiobooks, podcasts, speeches, comedy recordings, film recordings, prayers, video gameplay footage.
One song in one asset
Assets must contain one piece of intellectual property (ie. a song) only. A continuous mix, DJ mix, mashups, countdown lists, or compilation of tracks within one asset is ineligible.
Video game soundtracks
Sound recordings created primarily for use in a video game, such as the original score or background music accompanying a video game, which are owned by the video game’s publisher. This policy does not apply to licensed popular music, not originally created for the game.
