Introduction
This article explains what copyright compliance is, why it is important in digital music distribution, and how FUGA supports copyright compliance when responding to third-party rights queries.
Overview of Copyright Compliance
Copyright compliance refers to adhering to the legal requirements surrounding the use, distribution, and licensing of copyrighted material. In the digital music industry, this involves securing all necessary rights for sound recordings, compositions, and artwork before distribution.
Key aspects of copyright compliance include:
-
Verifying ownership of the content being distributed
-
Obtaining proper licenses for any samples, covers, or third-party materials
-
Ensuring that all metadata accurately reflects rights ownership
Music rights typically cover multiple elements, including sound recordings, compositions, and artwork. Distributors and labels must ensure full compliance for each element before delivering content to Digital Service Providers (DSPs).
Importance of Copyright Compliance
Adhering to copyright compliance standards protects all parties involved and supports a sustainable digital music ecosystem. Consequences of non-compliance can include:
-
Takedown of content by DSPs
-
Financial liability or legal disputes
-
Reputational damage to artists, labels, and distributors
-
Potential suspension or termination of DSP delivery privileges
To maintain compliance, it is crucial to:
-
Secure documented proof of rights ownership or licensing
-
Avoid using unlicensed third-party materials
-
Stay informed about evolving copyright laws and DSP requirements
Best Practices for Ensuring Copyright Compliance
-
Rights Clearance: Confirm rights for all content components, including recordings, compositions, and artwork.
-
Documentation: Maintain organized and accessible records of all rights agreements and licenses.
-
Third-Party Content: Exercise caution when incorporating samples, remixes, or covers to ensure proper licensing.
-
Regular Audits: Periodically review catalogue content to verify ongoing compliance.
Implementing these practices helps protect against disputes and ensures a smooth and sustainable distribution process.
FUGA’s Role in Supporting Copyright Compliance
If a third party contacts FUGA regarding a rights query related to delivered content, the following steps are taken to ensure compliance:
-
FUGA does not process DMCA claims directly. We recommend contacting the DSP where the content is hosted.
- Once we have received the claim from the platform, we then follow DMCA procedure. However, in certain cases, content may be temporarily removed from DSPs while the rights verification process is underway.
-
The client responsible for the content will be contacted to provide documentation confirming rights ownership.
-
Final actions are determined based on the outcome of the review. If the content is agreed to be removed from one platform for copyright infringement, it will be removed across all DSPs where FUGA have distributed it to.
